General Information:
This contract is between Blue View GSMD, a kennel owned by Megan & Dustin Westenmeyer, hereafter known as the breeder and ______________________________________________________________________________________________________, Purchaser. The puppy is being purchased on a Companion or Show Contract (please circle one).
The puppy purchaser understands and accepts when signing the agreement that: 1. Blue View GSMD will not offer cash refunds. 2. “Blue View” will be included as a prefix on puppy’s registered name. 3. Purchaser agrees to name puppy according to the litter theme. The breeder shall register all puppies. 4. All magazine advertisements relating to dog showing will include Blue View GSMD or Megan & Dustin Westenmeyer as the “Breeder”. 5. Any puppy that does not work out in their original home will be returned to the seller at the buyer’s expense. The puppy will be rehomed by the seller. If there is any net profit, after room and board costs are deducted, it will be given to the original buyer.
Breeder’s Responsibility (Blue View GSMD):
1. The guarantee that both the sire and dam of the Puppy are free of bilateral OCD, epilepsy, hip & elbow dysplasia. 2. The guarantee that both the sire and dam's hip and elbow joints are suitable for breeding. All of our breeding stock is OFA or Penn Hip certified. The reports are available to the purchaser at the time of purchase. 3. The guarantee that both the sire and dam are free of blinding eye problems. CERF results available to the purchaser at the time of purchase. 4. Breeder finds the Puppy to be sound in body and temperament. 5. Breeder’s Veterinarian has examined the puppy. Information from the examination, regarding the purchaser’s puppy, will be given to the purchaser before the sale of the puppy.
Purchaser Responsibilities: 1. To pay all transportation costs. 2. Upon request, provide proof (licensed Veterinarian statement or records) that all Vaccination protocols were followed. 3. To have OFA or Pen hip certification done between the ages of 2 and 3 years of age, if any concerns arise. 4. To have CERF certification done between 24 and 36 months of age, if any concerns arise. 5. To notify the Breeder, Blue View GSMD, if the puppy develops Bilateral OCD, epilepsy, bloat, gastric torsion, blinding eye condition, or cancer at any age, or any other health problems not listed here. 6. Purchaser understands, accepts and agrees to follow all responsibilities, terms and conditions of this contract and any attached documents (Feeding Protocols, Vaccination Protocols, Limitations for Prevention of Injuries to Puppies) signed by the purchaser that are attached to this agreement and that failure to do so will void all responsibilities and guarantees made by the breeder (Blue View GSMD). The purchaser will be held to the contract regardless.
Show Puppy: The show puppy prospects will be sold on a single owner or co-ownership (circle one) on an AKC limited registration basis. The registration will be changed to Full AKC registration, for the show puppy prospect, once the Buyer provides documentation to Blue View GSMD that the show puppy prospect owner/buyer has met the following conditions: 1. That he\she has been actively taking measures to train their dogs for competition at American Kennel Club (AKC) Conformation events by regularly attending conformation handling classes.
Health Guarantee (show prospect puppy): The puppy buyer agrees to follow feeding and vaccine protocol which is attached to this contract. If the puppy owner does not follow feeding and conservative vaccine protocols, then all Health Warranties are null and void. If one of the following conditions occurs to the show puppy prospect, that is documented by a veterinarian, Blue View GSMD will replace the show prospect puppy with a puppy of equal quality, when one becomes available: 1. If the puppy dies before the age of five from an inherited condition. 2. If the puppy develops arthritic conditions inside the hip joint accompanied by a Mild, Moderate or Severe Orthopedic Foundation for Animals, Inc. (OFA) rating before the age of three years. 3. A grade 2 or 3 OFA rating on elbows before the age of three years. 4. If the puppy develops blinding eye problems at or before the age of two years. 5. If the puppy develops bilateral OCD before the age of three years.
**The seller can require confirmation of the condition by a veterinarian of the seller's choosing. Such confirmation shall be at the seller’s expense.
In the event that the prospective show puppy does not have documentation of working towards its Conformation titles, it will fall under the health warranties found under Companion Prospects as discussed below.
Companion Puppy Puppy companion prospects will be sold only with a limited AKC registration, with a single ownership with spay/neuter agreements. We recommend: 1. Neutering male pups after 18 months of age. 2. Spaying female pups no sooner than 60-90 days after their first heat cycle. **Allowing the male puppy to remain intact until 18 months gives the giant breed puppy's body time to mature and makes use of the hormones found in an intact boy, which are very important to the proper development of the musculoskeletal system. Allowing the female puppy to go through one estrus cycle, helps to prevent early urinary incontinance issues. Health Guarantee (companion puppy):
If one of the following conditions occurs to the companion puppy that is documented by a veterinarian, Blue View GSMD will replace the companion puppy with a puppy of equal quality: 1. If puppy dies before the age of five from an inherited condition. 2. If the puppy shows clinical signs of soreness and arthritis in hip joints due to inherited genetic problems, and accompanied by a Severe Orthopedic Foundation of Animals, Inc. (OFA) rating before the age of three. 3. If the puppy develops blinding eye problems at or before the age of two. 4. If the puppy develops bilateral osteochondrosis dessicans (OCD) before the age of 3. 5. OFA Elbow ratings of grade 2 or 3 that is accompanied by clinical symptoms before the age of three.
The seller can require confirmation of the condition by a veterinarian of the sellers choosing. Such confirmation shall be at the seller’s expense.
***A replacement puppy will be sent to the buyer at the buyer’s expense only if the original puppy has documentation of neutering or spaying.
Venue & Entirety of Contract This agreement serves as the entire agreement. No prior or subsequent oral agreements will alter the aforesaid terms. This agreement will follow laws and regulations in the Commonwealth of Virginia. Any disputes will be resolved in the venue of the Commonwealth of Virginia. A civil penalty of $2000.00 plus court costs, and legal fees will be collected from the buyer if the agreement is not upheld.
